Fines for violating the Mobilization Law


The Verkhovna Rada has decided on the punishment for violation of mobilization and military registration in Ukraine.

The Verkhovna Rada Committee on Law Enforcement, when considering a bill to increase liability for military offenses, excluded criminal liability and determined the amount of fines for citizens, officials and legal entities. Chairman of the committee Sergei Ionushas (Servant of the People faction) told the UP publication about this. ):

“On April 8, we recommended that parliament adopt bill No. 10379 as a basis and, in general, with committee amendments. We proposed to exclude from the draft law all changes to the Criminal Code, that is, there will be no prison sentences for evading conscription for military service upon mobilization.”

He also said that the committee determined the amount of fines for violating the rules of military registration and mobilization. For violation of the rules of military registration (Article 210 of the Code of Administrative Offenses) in peacetime, a fine will be from 3,400 to 5,100 hryvnia, repeated or in a special period – from 17,000 to 22,500 hryvnia.

For violation of the legislation on defense and mobilization (Article 210-1 of the Code of Administrative Offenses) in peacetime, it is planned to establish fines from 5,100 to 8,500 hryvnia for citizens, 17,000-34,000 hryvnia for officials and legal entities. During martial law, fines will range from 17,000 to 22,500 hryvnia for citizens, and from 34,000 to 59,500 hryvnia for officials and legal entities.

Andrey Osadchuk, First Deputy Chairman of the Verkhovna Rada Committee on Law Enforcement, in a commentary to the UP clarified that the relevant bill will be considered in parliament in the near future – after the adoption of the draft law on mobilization.

The original version of the bill provided for criminal liability in the form of imprisonment for a term of 3 to 5 years for evading conscription for military mobilization, including refusal to undergo a medical examination. It was also planned to establish high fines: violation of the legislation on defense and mobilization in peacetime provided for the imposition of a fine on citizens and officials in the amount of 34,000 – 85,000 thousand hryvnia, and in a special period – 153,000 – 204,000 thousand hryvnia.
