The Association of Notaries at its last meeting decided to extend the strike until December 11. Notaries in Greece have decided to abstain from performing their duties from November 20, protesting against the way the digitization of notarial acts is proceeding.
They have now decided to continue the strike until mid-December, when a new meeting will be held to decide their future actions. During the voting, it was decided to continue the strike, with 315 votes in favor and 95 against.
Their latest statement reads: “We have decided to go on strike because, although we have fully agreed, three days ago a notice was published of an electronic international tender financed by the Ministry of Digital Governance and having as its main project the Greek Cadastre, which is supervised by the above-mentioned Ministry, which cancels everything we agreed on “.
Statement by notaries on the strike of November 20
“The Deputy Minister of Digital Governance, in his statement, presented his version of our decision to go on strike. In his statement, he lists what he asks of us as digital reform and what he does not ask for, ending his speech with a call for us to say specifically and transparently what exactly we are not agree.
Notaries are informed that what the Deputy Minister asks us to do as the so-called digital reform is already being done to the greatest extent, and what remains to be done we have long agreed to implement.
As for those things, as the Deputy Minister claims in his corresponding statement, which he does not ask us to do, we also inform you that they are not provided for either by the current legislation, or by the Greek legal system, or even by the European notary profession, and therefore he could not would ask us for them even if he wanted to.
The notaries have decided to go on strike because, although we have fully agreed, three days ago a notice was published for an electronic international tender, which is financed by the Ministry of Digital Governance and has as its main project the notary office Hellenic Trademark Registry, supervised by the above-mentioned ministry, which cancels everything about we agreed.
This is because the physical scope of the notification work involves something that the Deputy Minister is not supposedly asking us to do, and that is otherwise not covered by Greek law or even applicable in any European country. Although the scope of the relevant notice concerns us as users, we were not informed about this at all.
Likewise, the competent Ministry of Justice was not informed. It goes without saying that we must live in the digital age. We were the first to digitize notary services at our own expense. IN EUwhere digitization of notarial documents exists or is discussed, this is done by the author of the document, the notary, as well as the electronic storage of the digital notarial document.
We call for reform of the notification conditions that describe the preparation of electronic contracts through a platform foreign to the notary, in pre-selected forms and columns, once again recalling that each contract has its own characteristics and covers individual needs.
We ask that you carry out what we have mutually agreed upon. After all, as the Deputy Minister says, only we will implement all this.”
