"dodgers" from Ukraine: do they face deportation from European countries


The Ukrainian authorities are threatening to return to the country dodgers who fled to Europe from military service. Is it real?

Recently, the Strana newspaper writes, there have been many threats to initiate criminal cases against them and promises of extradition to Ukraine, but the implementation of such measures is doubtful, as well as the intentions to punish the owners of fake “white tickets”.

To prove the falsification of the diagnosis in order to obtain a “white ticket”, it is necessary to re-pass the medical commission or admit to receiving a bribe for the “fake” conclusion of doctors and military commissars.

The latter, as it is easy to understand, is completely unthinkable – why should they “hang” an article of the criminal code on themselves, if the evader has long since caught a cold, he is outside the country, and it is almost impossible to prove the crime. That is, it is theoretically possible, but in practice… It is easier to prove falsification of persons who remained in Ukraine, but their percentage is negligible.

Let’s say writes publication, the authorities will not particularly look for evidence, they will simply give the command to announce total suspicions to all “white ticket” holders who left the country after the start of the war. But the probability of their extradition will be close to zero. The most obvious action for men who have left the country is to apply for refugee status. During the consideration of the application, they will not be able to extradite them.

Even if, faced with a stream of such applications, the EU countries will refuse applications, the refusal can always be appealed in the courts. As is well known for a long time, they can drag on in Europe for a very long time …

It should also be noted that a large number of extradition requests against Ukrainians can cause an extremely negative public outcry for Ukraine in the European Union. Especially among the media and human rights organizations.

And one more nuance: because of the threat of initiating criminal cases, the men who left Ukraine and their families will not return to the country. Not only during the war, but also after it.
