The office of the President of Ukraine is trying to solve the problem of the further legitimacy of the head of state


Taking into account the fact that Vladimir Zelensky’s term as President of Ukraine expires in the spring, an appeal to the Constitutional Court on his further legitimacy is being prepared.

In exclusive material ZN.UA it saysthat an appeal to the Constitutional Court has already been prepared, but has not yet been submitted.

According to the Constitution of Ukraine (Part 5 of Article 103), the next presidential elections in Ukraine should have taken place on March 31, 2024. After all, on May 20, 2024, the five-year period specified by the constitution (Part 1 of Article 103) from the inauguration of Vladimir Zelensky expires.

The President’s Office is actively working to resolve the situation that will arise after May 20, the publication writes. One of the options is to appeal to the Constitutional Court with a proposal for an official interpretation of the provisions of the Constitution that regulate the holding of the next presidential elections and the five-year term of office of the president. According to the publication’s sources in the President’s Office, the presentation is already ready.

They want to pose several questions to the Constitutional Court. For example, does the constitution allow presidential elections to be held under martial law? The answer should clarify the prohibition of holding elections, which is provided for by the Electoral Code and the Martial Law Law.

The second question is about the legitimacy of presidential powers after the end of the five-year term in office, that is, after May 20. The OP believes that if a decision is made to appeal to the Constitutional Court with such a constitutional submission, then this will be done by people’s deputies from the Servant of the People, but the appeal has not yet been transmitted to the deputies of the presidential faction. As of yesterday, February 27, the publication notes, a final decision on the advisability of such a constitutional submission has not been made. The Constitutional Court confirmed that they have not yet received such a document from the Office of the President.
