Lesbos: 92-year-old man convicted of sex with 12-year-old girl

A case of rape by an old grandfather of a 12-year-old girl has outraged the public of Mytilene on the island of Lesvos. He was convicted and released… due to the expiration of the statute of limitations.

The incident occurred in June 2013, when a girl under 12 years old, suffering from a mental disorder, went for a walk on the street alone, unaccompanied by adults. At that time, an 82-year-old local resident approached the minor and, as the appeal court found, began to harass her.

The old man’s actions were described in detail at the court hearing by the mother and grandmother of the victim of sexual violence. She herself also recalled (during sessions with a psychiatrist) what she had to endure then. For many years the girl could not get rid of the feeling of guilt, believing that “she was to blame for everything.”

A mixed North Aegean appeal court of three judges and four jurors ruled unanimously on Wednesday morning (September 20) that the (currently 92-year-old) raped the girl 10 years ago, although he claimed he did no such thing. .

As a result, the rapist was released because the charge of rape on which he had been convicted was dropped, and his sentence for seduction and indecent behavior had already expired.

The victim’s family, as stonisi.gr notes, had many financial and personal problems, and therefore did not hire a lawyer. Thus, there was no civil trial at the trial and it was impossible to ask questions either to the witnesses for the defendant’s defense or to the gynecologist who examined the girl.

Nevertheless, the verdict of the psychiatrist, who confirmed that violence was used against the girl – acts of a sexual nature – convinced the prosecutor, who proposed leaving the indictment in its current form.

It is noted that the old man was found guilty of molestation and rape of a minor. He was sentenced to 8 years in prison. But due to the fact that the statute of limitations had expired, he was released.
