Shocking decision of the US authorities: illegal immigrants will be allowed to carry weapons

US District Judge Sharon Johnson Coleman made a groundbreaking decision: illegal immigrants will now be able to carry guns.

Sharon Johnson Coleman ruled that an illegal immigrant’s Second Amendment rights were violated when he was accused of illegally possessing a firearm. The case in question is Heriberto Carbajal-Flores, an undocumented immigrant who was charged under 18 USC § 922, a federal law prohibiting illegal aliens from carrying guns or ammunition.

However, Judge Coleman decided that the law, as applied to Carbajal-Flores, violated his constitutional right to keep and bear arms. The defense team successfully argued that the government failed to demonstrate how the law is consistent with America’s historical tradition of gun regulation, a requirement set by the Supreme Court in 2022. They argued that lifelong disarmament based solely on grounds of foreignness or citizenship had no roots in U.S. history or tradition.

Notably, Judge Coleman noted: Carbajal-Flores has no prior convictions for felonies, violent crimes or weapons offenses. She even admitted his claim that he acquired and used the gun solely for self-defense during a period of documented civil unrest.

The consequences of this decision are deeply troubling. By extending Second Amendment protections to illegal immigrants, the court effectively prioritized the rights of noncitizens over the safety of American citizens. This sets a dangerous precedent that could lead to an increase in the number of armed illegal immigrants, further undermining already strained U.S. immigration enforcement efforts.

Moreover, this decision raises serious questions about the consistency and coherence of the legal system. How can we justify granting constitutional gun rights to those who willfully violate immigration laws while law-abiding citizens face increasing restrictions on their Second Amendment freedoms?
