Christmas gift: when will it be credited, what to do if you haven’t received it

Enterprises are required to pay Christmas bonus to all employees who work for them, regardless of their employment relationship. Private sector workers are expected to receive their Christmas gift by December 21st.

According to ΓΣΕΕemployees who are in an employment relationship with the employer without interruption, during the entire period from May 1 to December 31 of each year, have the right to the entire “gift”, that is, a month’s salaryfor those who are paid daily wages, the employer is obliged to accrue its 25-day equivalent.

Employees whose relationship with the employer did not last the entire above period, are entitled to receive a portion of the amountaccrued in proportion to the duration of the employment relationship. The Christmas gift in this case is calculated as follows: 2/25 of a monthly salary or 2 daily salaries – depending on the method of payment – for every 19 calendar days of the employment relationship. Even employees who have worked for less than 19 days are entitled to a corresponding share of the Christmas doro. Unless work was carried out without interruption for the entire period from 1 May to 31 December, this period also includes all days during which employees were legally absent from work (for example, on annual leave, maternity leave) .

When absence of employees due to illness “three days of sick leave” are included in the calculation of the gift, i.e. time of absence during which sickness benefits are not paid and periods paid by the insurance company are deducted.

If an employee does not receive a Christmas gift, he must report this to the relevant authorities, since the employer does not have the right not to pay it or to pay and demand the amount back. According to the Information Center for Employment and the Unemployed:

Payment for the Christmas gift must be made before 21 December, with the date 31 December being a special day (ΑΠ 40/2002 Ολ.) and being the latest moment for its payment. In case the amount will not be paid on time, employees can contact the relevant labor inspectorate to file a complaint. The complaint is forwarded to the prosecutor for individual prosecution of the employer and at the same time to the relevant police department to initiate an automatic procedure.
