The Department of Labor circular on new parental and guardian rights was issued a few days ago.
The days of parental leave are increased from 2 to 14 days. The leave is valid until the child is one month old, and the father has the opportunity to take it in full or break it into fragments. Two days can also be provided before expected due date.
Leave to care for a child is provided by the employer without fail and does not depend on the previous place of work or work experience, as well as on the marital status of the employee. In case of adoption or custody of a child under the age of 8, parental leave is granted from the moment the child appears in the family.
It should be noted that the measure applies to fathers whose children were born from June 19, 2021, since the law was then published in the Official Gazette.
The four months of parental leave are granted either continuously or in installments. This applies to both parents, and OAED during the first two months assigns them an allowance in the amount of the minimum wage. The condition is that they have worked for the same employer for one year. The circular also includes unpaid leave for other family members.
Parents or guardians may also receive twice a year one day off due to force majeure (due to emergency family circumstances).
Besides parents of children under the age of 12 can request flexible hours, remote work, part-time work, etc. However, there is one condition – workers must work for 6 months with the same employer.
It should be noted that if an employee asks for any of the holidays and the employer fires him because of this, it is illegal. Cases of this kind are considered in court.
