Conclusion of a cohabitation agreement in Greece

With countless natural beauties, a unique history and culture, hospitable people and – not to mention – a great climate suitable for both summer and winter holidays, Greece every day attracts more and more visitors who want to experience her charm.

The capital of Athens, with its centuries-old historical and cultural heritage, combines the wisdom of ancient monuments and the dynamic power of a modern metropolis, which also does not leave indifferent all those who happened to visit this city.

In addition, having visited Greece once, you always want to return here again. Most often, the warm relations that arise between foreigners and representatives of the local population are also forced to return. So, many third-country nationals decide to change their place of residence, namely, they choose Greece, so as not to lose the established connection with their partner due to the distance separating them. And the fact that in Greece there are more and more couples consisting of people of different nationalities every year is a fact.

If many people manage to get a tourist visa to Greece without any special obstacles, then obtaining a residence permit in this country will require much more effort, since this procedure requires the fulfillment of certain, rather stringent requirements. Taking into account that a tourist visa has a specific validity period and requires a foreigner to stay in the country for no more than 90 days within six months, this condition puts the couple in a rather strict time frame, significantly complicating their life together with all the ensuing consequences. However, Greek law has been sufficiently improved with regard to issues relating to the cohabitation of representatives of Greek nationality or citizens of other European countries with third-country nationals. As a result, it became possible for the above foreigners to conclude notarized cohabitation agreement with a citizen of this state or any other European country residing in Greece. And now, taking into account many subsequent changes and additions, Greek law also provides for the formalization of relations in the form of such an agreement for same-sex couples.

So, for many civil partners – of different or same sex – a lot of problems were solved, starting with a residence permit for those who visited Greece only on a visa or an entry stamp in a foreign passport, and ending with property and inheritance issues that often worry and puzzle people who are unable to marry because of their gender or nationality.

One of the main conditions for concluding a cohabitation agreement is the legal stay of a third-country national in Greece, that is, an already existing residence permit of a different category, an entry stamp allowing the foreigner to stay in the country for three months, or a valid entry visa issued by a Greek consular office or another Schengen country. In addition, both parties to the cohabitation agreement must be free from the bonds of marriage and not be in another civil union like this.

An agreement drawn up by a notary and signed in his presence must be registered at the registry office at the place of residence of the couple, in confirmation of which a corresponding certificate will be issued to civil partners. Next, you can proceed to the procedure for issuing a residence permit for a citizen of a third country, for which you must submit an application to the authorized migration service along with the accompanying documentation. Based on the results of consideration of the application and processing of the package of documents, a primary residence permit will be issued for the civil partner of a citizen of Greece or another European country. Its validity will be extended provided that the cohabitation agreement remains in effect, that is, it has not been terminated or transformed into a marriage.
