Motor Oil fined €9.2 million for obstructing Competition Commission inspection


Greek Competition Commission fines oil company Motor Oil for 9.2 million euros and a related individual for 50,000 euros for obstructing an on-site inspection.

In its statement, the commission referred to article 39 of Law 3959/2011 (paragraph 5), which refers to inspections and the right to seal an office or documents, and said it had imposed fines “after taking into account the particular seriousness of the conduct in question, the neglect and its consequences for the ongoing investigation.”

The commission said its inspectors were at the Motor Oil site in Corinth to conduct an unannounced on-site inspection of the oil refining stages and wholesale and retail sales in the petrol and diesel markets, in accordance with an order from the commission's Directorate General of Competition.

“During the on-site inspection, the corporation “Motor Oil” and the individual not only did not actively cooperate, but by their actions and inactions they created obstacles, delays and difficulties during the audit and, thus, did not guarantee the integrity/availability of the company’s professional archives and the effectiveness of the audit.”– the message says.

“On the contrary, by their behavior they obstructed the inspection and violated the obligation [компании] actively and continuously cooperate with designated employees of the General Directorate of Competition. Thus, they made the investigation ineffective.”says the conclusion.
