Working on the Day of the Holy Spirit: who is entitled to a 75% salary increase


Today is Holy Spirit Day is not included in the list of official holidays, established by law for private sector workers.

However, as reported by the Information Center for Workers and the Unemployed of the Confederation (KE.PEA/GSEE), private enterprises in our country are late if that day was declared a holiday the decision of the regional governor, as well as the regulations of ΣΣΕ, the rules of the company, business customs and traditions, according to which the company remains closed on this day.

Likewise, more favorable conditions may apply to increased remuneration for work lawfully performed on the day of the Holy Spirit.

Who is entitled to a 75% salary increase

In case employees do not work as per the above conditions, they will receive their regular salary while those who are paid at daily rate will be entitled to receive their daily rate. It should be noted that counting the required day of rest (day off) against the Holy Spirit Day is illegal, since it is considered a mandatory public holiday.

Although Holy Spirit Day has been designated as an additional public holiday for the company, this year it operates as an exception, then working employees are entitled to a 75% increase calculated from their daily salary (if they receive a daily salary) or 1/25 of their monthly salary (if they receive a monthly salary).

In accordance with the special provisions of the relevant collective agreements or other decisions, holiday payment category is established For the following categories of workers:

  • Bookstores
  • Diagnostic centers
  • Journalists
  • Project Managers
  • Nursing home
  • Industrial and workshop electricians
  • Doormen
  • Tobacco industry
  • Clinics
  • Wooden warehouses (Athens – Piraeus – Perichoron)
  • Oil companies
  • Shipping Agencies
  • Radio electricians – Industrial radio engineers
  • Radio stations
  • Marine rescue and tug service employees
  • Television station workers
  • Television technicians of Northern Greece
  • District newspaper printing houses
  • Daily newspaper movers
  • Secondary, higher educational institutions and foreign language centers
  • Photocopy workers
  • Industrial Business Operators
  • Stone and marble quarries and technical work.

How do those who work on the Feast of the Holy Spirit get paid?

The Feast of the Holy Spirit is not one of the official holidays designated by law for private sector employees. However, private business in our country is late when the Holy Spirit Day is declared a holiday by the provision of the company's Labor Code, business habit and custom during which the business remains closed on this day. Thus, employees employed on these days:

a) if they are daily wage workers, they are entitled to receive their normal daily wages without any increase;

b) If they are paid a monthly salary, they are not entitled to any additional remuneration over and above their normal monthly salary.

If the business is usually closed on these days:

(a) Those who are paid a day's wages are generally not entitled to receive their daily wages as there is no provision of law establishing a general duty on employers to pay a day's wages on unused public holidays. Barring, of course, custom or business practice, or SSE, etc., it is predicted that they will be late on these holidays, but will pay the appropriate day's wages,

(b) those who are paid a monthly salary usually receive a salary without any additional remuneration.

If the enterprise is usually closed on these days and worked in exceptional cases by the unilateral decision of the employer:

a) persons receiving daily wages are entitled to their normal daily wages

b) employees are entitled to receive an additional 1/25 of their salary (since the salary corresponds to the working days of the month, and this day was not a working day for them and, therefore, remuneration for that day).

If the enterprise operates normally on these days and in exceptional cases did not work, by the unilateral decision of the employer, those receiving the daily wage are entitled to receive the daily wage in accordance with the overtime regulations of the employer, and those who are paid the daily wage, are entitled to receive daily wages in accordance with the employer's overtime regulations. Employees receiving monthly wages are not entitled to any other remuneration other than the regular monthly salary.

For public sector employees – ΝΠΔΔ and OTA – Holy Spirit Day is a holiday. In addition, the Feast of the Holy Spirit is recognized as a holiday in accordance with special provisions of collective agreements or other decisions for certain categories of workers.
