Unpaid Rent Could Cost 45%: How Owners Can Avoid Tax on Money They Didn’t Receive

In Greece, you can not get rent, but still receive a tax bill. Property owners whose tenants have not paid for 2025 need to take legal action and send supporting documents to ΑΑΔΕ. Otherwise, the unpaid amounts will be considered ordinary income and will be subject to tax.

Rental income is taxed separately, from the first euro. The rate can go up to 45%. That is, the owner risks finding himself in a familiar Greek trap: the apartment is not available, there is no money in the account, and the tax is already quite real.

The main thing is several points

  • Unpaid rent for 2025 is not automatically exempt from tax.
  • To July 15, 2026 the owner must take legal action against the tenant.
  • An order for payment, an order for the return of the property, a judgment or a claim for the collection of rent will be suitable.
  • A form must be submitted to ΑΑΔΕ E411 through the service “Τα Αιτήματά μου” in myAADE.
  • The form is submitted separately for each tenant, object and supporting document.
  • If the documents are not submitted, the tax office will not recognize the amounts as uncollected and will charge tax as ordinary income.

Who faces tax on money that didn’t exist?

The problem concerns owners who did not receive part or all of the lease under the contract in 2025. The mere fact of delay does not mean that the income automatically disappears from the tax return.

For ΑΑΔΕ it is not enough to say: “the tenant did not pay.” Documents are needed confirming that the owner has actually begun the procedure for collecting the debt or returning the property.

If this is not done, the amounts will be included in the declaration as income from real estate. And then the system, as usual, will show enviable adherence to principles precisely where the person has not even seen the money.

What needs to be done before July 15

In order for 2025 rent to be considered uncollected and tax-free, you must have at least one of the following documents before the due date:

  • court order for payment of debt;
  • order to return the rented object;
  • court decision to evict a tenant;
  • court decision to collect rent;
  • a lawsuit filed for eviction or debt collection.

After this, the owner must submit an electronic application to ΑΑΔΕ through the section “Τα Αιτήματά μου” on the myAADE platform.

Form E411: Master Document for the Owner

The application is accompanied by a form E411intended for declaring uncollected income from rental or sublease of real estate.

The form is submitted separately for each tenant, each property and each document on which the claim is based. It contains the details of the tenant, the address of the property, the amount of unpaid rent and the tax year.

It is at this stage that errors often occur: the owner submitted one general document, did not attach a court decision, or indicated incomplete data. As a result, ΑΑΔΕ may not recognize the amount as uncollected.

Special cases: bankruptcy and pending eviction

If the tenant is declared bankrupt, the owner will also need a table of declared creditor claims, which indicates his claim for the debt.

A separate procedure applies when an order to return housing or a decision to evict has already been issued, but the tenant himself has not yet actually left the property. In this case, you must submit:

  • a declaration by the owner that the lease was not received;
  • act of the bailiff on the eviction and transfer of the property to the owner.

How to reflect amounts in the declaration

Unpaid rent for 2025 is first reported on the form. E2in a special column for uncollected income. The data is then automatically transferred to E1.

If the owner had previously declared the rent uncollected but actually received the money in 2025, that amount must be reported as income for the year the rent was actually received.

Rental income is taxed separately from the first euro. Before settlement, a standard 5% reduction is recognized for repairs, maintenance and operating expenses of the property. However, this discount is of little consolation to the person who is trying to be taxed on an empty wallet.

What happens if you don’t submit anything?

If the owner does not submit E411 and the necessary documents, ΑΑΔΕ will not recognize the rental amounts as uncollectible. After this, the tax office can carry out a new calculation procedure and charge tax on all declared income.

Important point: this does not abrogate the owner’s right to collect the debt from the tenant. But without following the procedure, he may find himself in a double disadvantage: first, he will not receive rent, and then he will have to pay taxes on someone else’s debt.

Editorial comment

The Greek system once again asks the owner to prove that he is not a camel, not a bank or not a charitable foundation for the tenant. The person has already encountered a defaulter, spent money on a lawyer, court documents and executors, and then must still have time to collect a package of papers so that the state does not decide: since the lease was provided for in the contract, it means it is definitely in his pocket somewhere.

The principle of protection from tax on uncollected income is sound. But its implementation is structured in such a way that the owner must first start a legal battle, then fill out the forms correctly, attach evidence and not miss the deadline. Otherwise, the tax office will simply consider the income real without unnecessary drama.

As a result, the state formally fights tax evasion, but in practice creates a situation in which the taxpayer is forced to prove the absence of money with almost the same energy with which he tries to return it.
