Easter payment (Δώρο πάσχα): What employees need to know

Before the Great Wednesday, April 16, should be paid Easter payment (Δώρο πάσχα) All employees of the private sector.

Δώρο πάσχα, like Dor χριστουγέννων (gift for Christmas)have the right to receive all employees of the private sector in the Greek territory, in accordance with collective labor contracts (σσε).

The provisions of the legislative framework on festive gifts are mandatory, therefore, any contradictory obvious or silent agreements, as well as the employee’s refusal to pay them invalid.

Thus, according to the current legislation, all employees employed in the private sector under the employment contract for an indefinite or certain period of full or partial employment with any employer are entitled to Δώρο πάσχα.

How the Easter payment is calculated (Δώρο πάσχα)

This is half the monthly salary if the employee receives a salary, or 15 day earnings, if he receives hourly payment. However, if the employee’s labor relationship with the employer did not last the entire specified period, whether it is, at his own free will or, in the case of dismissal, he has the right to proportional payment of the Dor πάσχα, which is calculated as follows:

For employees with salary, the amount is equal to one -day earnings, depending on the agreed payment method for every 8 (eight) calendar days. If the employee has worked for less than eight days, he has the right to a proportional share Easter payment.

If the employee fell ill in the indicated period, only those days for which he received illness due to illness from the insurance fund will be deducted.

Example: If the employee was absent at work due to an illness of 60 days and received an illness for illness from his insurance fund only in 40 days, then only 40 days for which he received benefits, not 60, will be deducted from the working period.

When the Easter payment is paid

Easter payment is usually paid to the great environment, but employers can pay it earlier, if they want it.

Periods that are not taken into account

The days are not taken into account when the employee was absent at work for no good reason or for unpaid leave. The period of lack of employees is not taken into account due to trade union activities (that is, the time of trade union leave).

As for the strike, judicial practice believes that the days of the strike are not taken into account in the period of labor relations, since the absence of the employee is due to his own desire and cannot be qualified as respectful absence. Similarly, this applies to work stops, since they are also actually a strike.

What to do to the employee if he is not paid Easter payment

If Easter payment Not paid on time, employees and/or trade unions can and should apply to the relevant labor inspection to draw up a complaint. It is transferred to the prosecutor to initiate a criminal case against the employer, and is also sent to the appropriate police station to start the detention procedure.

Workers and/or their trade unions have the right file a complaint Directly to the appropriate police station and request the application of the detention procedure. It is important that the company's data and the address of the employer are indicated in the complaint, if possible, since the detention procedure lasts up to 48 hours.

In any case, if Easter payment Not paid within the prescribed time, labor inspectors are required to intervene immediately, conducting inspections and being fully readiness for the application of the detention and imposition of the appropriate sanctions.

Workers can file anonymous or named complaints By a single service number 1555 or through the electronic supply service anonymous complaints of labor inspectionor by sending a message by e -mail (email) to the inspection department at the place of work.
