Prosecutor Stelios Kostarelos proposed that a jury of the Mixed Court of Appeal convict the two accused in the death of 33-year-old Zach Kostopoulos.
The prosecutor asked that the jeweler from Gladstonos Street and the broker be convicted, as in the first instance, of causing grievous bodily harm. In his brief speech, S. Kostarelos noted that it was the blows to the head inflicted by the defendants that led to death and asked to reject the defendants' claim that they were defending themselves.
According to him, “Although they knew that the blows to the head could have resulted in the death of Zach Kostopoulos, and had the ability to foresee the outcome, they still attacked Zach, striking him in the head.”
Their claims that they were defending themselves or purporting to defend themselves are untenable as they were safe outside the store and smashed most of the display window while Kostopoulos was alone in the store and the police were called and his arrest was certain.
The prosecutor pointed to witness statements and video recordings, which he noted showed a “scene of lynching.”
“The accused began kicking the glass door of the jewelry store and furiously began hitting him on the head, which swung left and right, causing him to hit the glass. One of them dragged him to the sidewalk and then disarmed him, taking a sharp piece of glass from his hands. Zach Kostopoulos was still breathing and conscious. One of them kicked him a total of 9 times, 5 of which were to the head, and the other kicked him 5 times to the body and 3 to the head.”
As for the conclusions forensic expertsS. Kostarelos noted that it follows from them: “there was no heart pathology” and they talk about “ischemic type of myocardial damage, causally associated with death through the mechanism of stress.” The fact that Zach Kostopoulos was HIV positive, took drugs and was in a state of “withdrawal symptoms“, for some reason the expert did not include the possible causes of death.
The trial will resume on June 4, when lawyers will present their arguments.

There were so many nuances and inconsistencies in this case, in which a biased attitude towards the defendants is clearly visible, that one can safely speak of a “made-to-order case.” Starting from a 2-month examination for the presence of drugs in the body of Zach Kostopoulos, when the investigative authorities repeatedly rejected the results of the examination, which contained traces of drugs, until the last analysis showed their absence.
Previously, toxicology tests showed that Zach Kostopoulos was not under the influence of drugsc, and only minor traces of alcohol were traced in his blood. However, the examination data don't deny itthat the deceased was in a state withdrawal symptoms syndrome (withdrawals). To reach this conclusion, it was enough to watch the video of how Kostopoulos behaved, and not the examination data.
All the experts interviewed by the editors are inclined to believe that the main reason is the fact that Zach Kostopoulos was an LGBT activist. And the LGBT lobby thus used Zach’s death as a reason to strengthen its own position in society, and also showed the entire population of the country that “it’s better not to mess with us,” Greek version of American George Floyd…
