Head of the Ministry of Internal Affairs of Ukraine: men who illegally left Ukraine are waiting for up to 10 years in prison

On site The Verkhovna Rada of Ukraine adopted a draft law on the punishment of men who illegally left the territory of Ukraine after the start of the Russian invasion on February 24, 2022.

It is assumed that he may soon be accepted, and “fugitives” may face up to 10 years in prison, writes “UP”. After the start of a full-scale war, martial law was introduced on the territory of Ukraine, and the Verkhovna Rada approved a presidential decree on general mobilization. Men liable for military service between the ages of 18 and 60 cannot travel abroad. But there are still exceptions.

The website of the State Border Service published information about which of the men has the right to leave Ukraine under martial law. According to Article 23 of the Law of Ukraine “On mobilization training and mobilization”, writes publication “Ukraine today”, men have the right to leave:

• who have a certificate of deferment from conscription and a notification of enrollment in a special military register;
• who have a conclusion of the military medical commission on unfitness for service;
• who are dependent on three or more children under the age of 18;
• who have a child with a disability under the age of 18 or an adult child with a disability of group I or II before they reach the age of 23;
• who care for those in need of assistance, in the absence of other persons who can do this;
• whose close relatives died or went missing during the anti-terrorist operation;
• adoptive parents, guardians, trustees, foster parents, parents raising orphans or children deprived of parental care, under the age of 18 years.

Men who illegally left Ukraine face punishment, Interior Minister Igor Klymenko said:

“At the end of the war, the state will do everything to remind every citizen what he did during the war. I mean those who illegally crossed the border. I think it will be a law. I think it will be a joint initiative of the Cabinet of Ministers and deputies Verkhovna Rada. They must answer for violating the law. I think every citizen wants this and the state will understand if there are any restrictions on the further movement of these citizens, at least abroad.”

True, such a law has not yet been adopted, and according to Article 58 of the Constitution of Ukraine, no one can be held responsible for acts that at the time they were committed were not recognized by law as offenses. However, it is worth waiting for how the law, which is now being discussed in the Verkhovna Rada, will ultimately look like.
