Three and a half thousand euros will be allocated by the state to the relatives of those killed in Tempi


3,500 euros – this is the amount of state assistance that the authorities intend to allocate for the funeral of those killed in the train accident in Tempi.

Ministry of Labor refutes the information about trying cut government spending on funerals dead. In particular, the press service of the Ministry of Labor and Social Affairs issued the following message: “Regarding the rumors about alleged cutbacks public spending on the funeral of the victims of the tragedy in Tempi emphasizes that they completely unfounded. On the contrary, in accordance with the adopted joint ministerial decision, the amount of public expenses for the funeral of victims of natural disasters or accidents is set at 3,500 euros. The relevant decision will be published tomorrow,” writes iefimerida.gr.

It should be noted that earlier Hellenic Train informed the public that it would not activate the provision of the law on exemption from damages As Hellenic Train said in a statement, “Sharing the national mourning that the entire country has been plunged into (…), Hellenic Train SA provides full compliance with current European legislation with all the necessary actions so that the rights of the relatives of the dead, injured and passengers of train IC62 of 28.02.2023 are fully respected on the basis of Articles 11 and 13 EU 1371 /2007″.

Compensation and advance

In accordance with European regulations, in the event of the death or injury of a passenger, the railway company, without delay and in any case no later than 15 days after the identification of the natural person entitled to compensation, allocates the amounts necessary to cover immediate financial needs, in accordance with the damage caused.

The advance payment is at least EUR 21,000 per passenger in the event of death. Of course, it is specified that advance payment is not an admission of liability and can be offset by any other amountpaid in accordance with the rules and is non-refundable when the damage caused was caused by the negligence or error of the passenger.

What does the European regulation provide for?

Regulations 1371/2007 and 2021/782 provide that the carrier is liable for damage resulting from death, injury or any other attack on the physical or mental integrity of the passenger, which was caused by an incident related to the situation on the railway at the time when the passenger remains inside, enters or exits the railway vehicles, regardless of the railway infrastructure used.

Exempted from liability:

a) if the accident was caused by circumstances external to the railway activities, which the carrier could not avoid and the consequences of which he could not prevent, despite the required and undertaken efforts,

b) if the accident occurred due to the fault of the passenger,

c) if the accident occurred due to the behavior of a third party, and the onset of consequences that the carrier could not avoid (or prevent), despite the efforts required and made by him.

The regulation also provides the possibility of exceptions to the rules. As noted in the text, railway companies in some Member States may find it difficult to fully implement the provisions of the regulation once it enters into force. For this reason, Member States may grant temporary exceptions to the application of provisions for long-distance domestic passenger rail transport.

With the amendments to Regulation 2021/782 aimed at strengthening the protection of passengers’ rightsprovided that Member States must inform the European Commission when they exempt rail passenger transport from the application of certain provisions of the regulation. They should even explain the reasons for granting such exemptions and the measures taken or planned to be enforced when they expire.
