ECtHR recognized Russian control over Donbas since May 2014

The European Court of Human Rights recognized that the Russian Federation has controlled part of the Donetsk and Luhansk regions since 2014, so thousands of lawsuits can be considered against it.

As informs Reuters agency, a court in Strasbourg decided on the possibility of considering complaints about the events in Donbas, including three lawsuits from Ukraine and the Netherlands against Russia. Two of them concern human rights violations in separatist-controlled territories, and one concerns Moscow’s alleged guilt in the 2014 Malaysian Airlines crash.

The Russian Federation has stated that it does not control the separatists in the DPR and LPR, denying the possibility of considering claims. However, the court ruled that she had significant influence on the military strategy of the separatists, carried out artillery shelling of the territory of Ukraine at their request, provided weapons and could be responsible for the events that took place on their territory.

After the adoption of this decision, the court will consider the case of Ukraine and the Netherlands v. Russia on the merits, as well as thousands of other cases that were awaiting this decision, the newspaper notes.
