Russia: imprisonment for surrender

The State Duma of the Russian Federation in the second and third reading today adopted a bill on “mobilization”, “wartime” and punishment for voluntary surrender.

In the Criminal Code of the Russian Federation, as reported Russian medianew terms will appear, and the toughening of punishment for a number of crimes during wartime will also be legislatively fixed, in particular:

  • from three to 10 years in prison for surrender (Article 352.1 of the Criminal Code of the Russian Federation);
  • up to 15 years in prison for looting (Article 356.1);
  • up to 5 years in prison for unauthorized abandonment of a unit during the period of mobilization and martial law for a period of two to 10 days (Article 337 of the Criminal Code of the Russian Federation);
  • up to 7 years in prison for unauthorized abandonment of a unit during the period of mobilization and martial law for a period of 10 days to one month;
  • from 5 to 10 years in a colony for unauthorized abandonment of a unit during the period of mobilization and martial law for a period of more than a month;
  • from 2 to 3 years in prison for non-fulfillment by a subordinate of the order of the chief, given in the prescribed manner, during the period of martial law.

The bill comes into force from the day of its official publication. It should be noted that to date, martial law has not been introduced in Russia and mobilization has not been announced.

Russian human rights activist Pavel Chikov draws attention to the fact that “an unremarkable bill on amendments to the Criminal Code, adopted in the first reading in July,” was amended by the second reading. They introduce the concepts of “mobilization”, “martial law” and “wartime” into the Criminal Code, and also introduce penalties for surrender, looting, abandoning a unit and failure to comply with an order. New criminal articles are also being introduced: “Voluntary surrender” (Article 352.1) and “Looting” (Article 356.1), writes an independent edition “Cold”.
