Obligation to vaccinate persons over 60 years of age and a fine of 100 € legalized

The decision on mandatory vaccination of persons over 60 years of age was declared legal, according to the decision of the Supreme Council of State (Supreme Court of Greece), signed by the Chairman of the Council of State, Dimitris Skaltsunis, on the last day of his stay in the judiciary, since from 07/01/2022 he leaves office due to the release on retire.

Decision is made by a majority of one casting vote and with one advisory vote of the chairman in a closed session of the Plenum of the Supreme Court of Cassation, during which all four applications for annulment filed by court officials, lawyers, were rejected. Including a statement of claim from a priest, a retired teacher, private employees, etc.

Thus the Plenary Session of the State Council “decided, inter alia, that the compulsory vaccination measure for individuals over 60 years of age, established by Article 24 of Law no. epidemiological data and aims to serve the interests of unloading the healthcare system and eliminating the risk of occupying all intensive care units.

(«κρίθηκε, μεταξύ άλλων, ότι το μέτρο του υποχρεωτικού εμβολιασμού των φυσικών προσώπων άνω των 60 ετών, που θεσπίζεται με το άρθρο 24 του ν. 4865/2021 και εξειδικεύεται με τις προσβαλλόμενες πράξεις, αποτελεί συνταγματικά ανεκτό περιορισμό των ατομικών δικαιωμάτων των διαδίκων, επειδή βασίζεται σε επίκαιρα και τεκμηριωμένα επιστημονικά και επιδημιολογικά δεδομένα και αποσκοπεί στην εξυπηρέτηση σκοπών μείζονος δημόσιου συμφέροντος, δηλαδή στην προστασία των ατόμων της ηλικιακής αυτής ομάδας έναντι της βαριάς νόσησης και του θανάτου, στην αποσυμφόρηση του συστήματος υγείας και στην αποσόβηση του κινδύνου κατάληψης όλων των ΜΕΘ“.)

The court ruled that “a fine of 100 euros per month, provided for by the provision of article 24 of law no. 15.4.2022 to 30.9.2022 by virtue of the twenty-ninth article of Law no. 4917/2022 and GP οικ. 20906/11.4.2022 of the Minister of Health, which was issued prior to the discussion of the applications on 6.5.2022, the total amount of the fine, limited to half the months of January and April and the months of February and March 2022, cannot exceed the amount of three hundred (300) euros”).
