The Office for Personal Data Protection charged a company with a fine of 5,000 euros for sending advertising messages without the consent of the recipients.
As it became known, complaints about the company and its aggressive advertising policies were submitted to an independent body. Citizens complained that despite repeated requests to remove their details from a particular mailing list and not send them any more messages, the company continued to “pretend nothing was happening.” A total of 78 citizens have applied.
At the same time, the company’s management referred to technical problems (inability to delete citizens’ data from the system). Therefore, the distribution of messages in order to promote the product continued.
In particular, a duplicate of the applicant’s address was created in the e-mail database. This technical error has been discovered and fixed so that it will no longer recur in the future, the company said.
The investigation was carried out by the Office for the Protection of Personal Data. It was established that there were “78 more cases of neglect of the right to remove personal information from the mailing list”. Thus, it turned out that, in practice, the company did not have the necessary procedures to ensure the deletion of data in order to comply with the requirements of ΓΚΠΔ (Γενικός Κανονισμός για την Προστασία των Δεδομένων) and to uphold the rights of citizens to protect personal data.
For this reason, the Office considered that there had been a violation of the law. The fine was collected.
